Affidavit of Non-Interest

Dorotteo M. Lompia filed a criminal complaint against Marlindo Tegerero y Igdalino for serious physical injuries that occurred in November 2021. AFFIDAVIT OF SETTLEMENT

I, DOROTEO M. LOMPIA, 43 years old, married, and a resident of


Gandara, Samar, after having been sworn to in accordance with law, do hereby
depose and state: THAT—

1. I am the private complainant in a criminal case for the crime of Less


Serious Physical Injuries against MARLINDO TEGERERO y
IGDALINO which occurred on November 29, 2021, at about 9:00
o’clock in the morning, in Gandara, Samar;

2. After a conciliation meeting with MARLINDO, I hereby declare that the


same arose out of pure misunderstanding and misapprehension of facts;

3. Based on the said misunderstanding and misapprehension of facts, I


manifest that I now withdraw my complaint against MARLINDO and
that I am no longer interested, and I hereby desist, in filing the above-
mentioned case provided that MARLINDO TEGERERO y IGDALINO
will gave me forty thousand pesos (P40,000.00) as assistance for the
expenses I incurred during my recovery and recuperation;

4. The forty thousand pesos (P40,000.00) shall be paid in three (3)


instalment basis. First payment of twenty thousand pesos (P20,000.00)
shall be paid on or before January 20, 2022. Second payment shall be
paid in March 2022. The third and last payment shall be paid in April
2022;

5. This Affidavit should, however, not be understood as a waiver or


relinquishment of any of my rights to pursue any legal action that I may
file in connection with any act or omission that MARLINDO may
commit in the future;

6. I hereby release MARLINDO from any and all criminal liabilities and
waive any right of action against MARLINDO in connection with above
case;

7. I fully understand the legal consequences of this Affidavit, and that I


have not been coerced, intimidated and unduly influenced in executing
this Affidavit;

8. This Affidavit was explained and translated to me in Waray dialect, the


dialect I understand and speak;

9. I am executing this Affidavit to attest to the truth of the foregoing


statements;

IN WITNESS WHEREOF, I have hereunto affix my signature this 14th day


of January 2022 in Gandara, Samar, Philippines.
