AFFIDAVIT OF COMPLAINANT

I, PMAJ ALWIN A BALLETE, of legal age, married, and a resident of Borongan City,
Eastern Samar, after having been sworn to an oath in accordance with law, do hereby depose and
say THAT:

1. I am a regular member of Philippine National Police presently assigned as Acting


Chief of Police of Dolores Municipal Police Station, Dolores, Eastern Samar;

2. On April 15, 2022, at about 11:30 in the morning, I and police officers conducted
mobile patrol in Poblacion, Dolores, Eastern Samar, on board our service vehicle.
While conducting mobile patrol somewhere in in Barangay 7, Dolores, Eastern
Samar, we noticed a Two Male person gathering and collecting timber at the
motorized Banka. Upon my instruction, PSSg Darwin Rapatan and PSSg Samuel
Calo, immediately alighted from the service vehicle and approached the said male
persons;

3. PSSg Darwin Rapatan and PSSg Samauel Calo asked them if they have the necessary
permit for the possession of the cut timbers. However, they showed nothing;

4. Thus, PSSg Darwin Rapatan and PSSg Samuel Calo arrested the said persons who
possess cut timbers without license from the Department of Environment and Natural
Resources;

5. The arrested male persons identified as Dave Peczon y Placeinte, 22 years old,
single, and a resident of Barangay Denigpian, Dolores, Eastern Samar and Pedro
Glino y Contado 23 years old Married a farmer and a resident of Brgy Denigpian
Dolores Eastern Samar and and Eddie Ranille 38 years old married and a farmer a
resident of brgy Denigpian Dolores Eastern Samar who was the owner of the said
lumber eluded arrest by not returning to the unloading area after their first haul upon
noticing the presence of the police at the said place to unknown direction;

6. PSSg Rapatan, informed all arrested suspect for the cause of the arrest, which is,
violation of Section 68 of Presidential Decree No. 705 (as amended) or cutting,
gathering and/or collecting timber or other products without license. PSSg Calo,
likewise informed them thier constitutional rights in a language known to and
understood by them;

7. Likewise, PSSg Darwin Rapatan and PSSg Samuel Calo confiscated from the
possession of Dave Peczon y Placeinte and Pedro Glino y Contado 66 pieces
2x2x12 and 22 pieces 2x3x12 with an estimated volume of 396 board feet with an
market value amounting to Nine Thousand Nine Hundred Pesos (Php 9,900.00) at 25
pesos per board feet and motorized Banka color orange and blue with 2 engine
(CAMA) ;

8. Thereafter, we went to the office of the CENRO DENR for the scaling and
geographical tagging of the confiscated cut timber in the place of arrest and seizure
at, Barangay 7, Dolores, Eastern Samar but there office are close and no duty
personnel are around;
9. Afterwards, all arrested suspect was brought to Dolores Municipal Police Station
including the confiscated cut timbers for preparation of filling a complaint while the
Motorized Banka remain near old Police Station office.

10. I am executing this affidavit to attest the veracity of the foregoing statements and to
support the filing of case against Dave Peczon y Placeinte, Pedro Glino y Contado
and Eddie Ranille (At Large) for violation of Section 68 of P.D. 705 (Revised
Forestry Code of the Philippines) as amended before the Office of the Provincial
Prosecutor (Sub-Office), Dolores, Eastern Samar.

IN TRUTH WHEREOF, I will affix my signature below this 15th day of April 2022 at
Dolores Municipal Police Station, Dolores, Eastern Samar, Philippines.
