wherein the victim is Angel Bilugan y Combo, 17 years old, female, single, out of school
youth and a resident of Purok 6, Brgy. Urdaneta, Lavezares, Northern Samar. Incident
transpired on or about 1:00 o’clock in the afternoon more or less of December 13, 2020
at Purok 6, Brgy. Urdaneta, Lavezares, N. Samar. Wherein the suspect was identified
as:

and a resident of Purok 6, Brgy. Urdaneta, Lavezares, Northern Samar, after being
sworn in accordance with law, depose and say:

That in accordance with A.M. NO.12-8-8-sc, which prescribe the use of Judicial
Affidavit to serve as s direct testimony of a witness, on the basis of which the adverse
party may conduct his cross-examination on such witness, we hereby execute this

Sagot- Noong December 13, 2020, bandang ala 1:00 ng hapon sa loob
ng bahay namin sa Purok 6 Brgy. Urdaneta, Lavezares Northern
Samar.
8. Tanong- Maari mo bang isalaysay sa akin yung nangyari noong December
13, 2020?
Sagot- Noong December 13, 2020, mga bandang alas 9 ng umaga
umalis ako at ang aking anak na si Alaisa papuntang Allen N.
Samar para bumili ng sapatos niya, mga bandang alas 2 ng hapon
pauwi na kami ng bahay. Malayo palang medyo kinakabahan na
ako at dahan-dahan kung pinatakbo ang aking motorsiklo
papalapit sa bahay namin na nasa gilid ng kalsada at habang
papalapit kami nakita ko na si Robert na sumilip sa bintana at ng
pag hinto ko sa tapat ng pintoan namin narinig ko si Ale, na nag
sabi “Hala, nandyan na sila mama” at nakita ko si Angel na
tumakbo palabas sa kwarto naming mag-asawa papunta sa
kwarto nilang magkakapated. Pagpasok ko sa loob ng bahay,
karga ni Robert ang anak namin na si Roselyn at maya-maya
nilagay niya ito sa kwarto naming mag asawa at lumabas siya ng
bahay para bumili sa tindahan ng sigarilyo at dali-dali kung
tinanong si Ale, kung bakit kailangan niya pang mag sabi na “
Hala, nandyan na sila mama”? ang sagot niya sakin kasi andon si
Papa Robert at ate Angel sa kwarto niyo at dali-daling kinarga ni
Papa Robert si Baby Roselyn kahit hindi naman umiiyak.
9. Tanong- Ano naman ang sumunod na nangyari?

Sagot- Mga bandang alas syete ng gabe noong December 13, 2020,
katatapos palang naming mag haponan, lumabas si Robert ng
bahay para bumili ng sigarilyo sa tindahan at medyo natagalan
siya sa labas dahil nanunuod ng TV at doon ko tinanong si Angel
kung ano talaga ang totoong nangyari at sabi ko sa kaniya na
huwag siyang matakot kasi uuwi na kami sa Papa niya at
pagkatapos kung magsalita napaiyak si Angel at sabi niya sakin,
“Oo, mama hinawakan ni kuya Robert ang dede ko.
10. Tanong- Sa ngayon ang imbetigador ay wala nang katanungan sayo,
meron kapa bang gustong idagdag sa iyong mga salaysay tungkol
sa insidenting ito?
Sagot- Meron pa maam, noong February 3, 2021, umuwi kami ni Angel
sa Brgy. P. Tingzon, San Jose N. Samar sa bahay ng magulang
ko dahil kaarawan ng mama ko at doon tinanong ko ulit si Angel
kung yun lang ba talaga ang ginawa sa kaniya ni Robert, sabi ni
Angel, mama, hinubaran ako ni kuya ng shorts at panty at pinasok
niya ang ari niya sa ari ko sabi ko sigurado ka ba na pinasok
niya o dinikit lang? sabi ni Angel “Oo, mama, nagtanong pa nga si
kuya Robert sa akin kung masakit ba?ang sabi naman ni Angel,
Oo, masakit, ang sagot naman ni Robert kay Angel na dahan-
dahanin ko lang huwag kang maingay at huwag kang mag
susumbong kay mama mo, pag nag sumbong ka papatayin kita
pati mama at ate mo.
11. Tanong- Sa ngayon ang imbetigador ay wala nang katanungan sayo,
meron kapa bang gustong idagdag sa iyong mga salaysay tungkol
sa insidenting ito?
Sagot- Wala na po Ma’am.

kwarto namin at kumuha ka ng damit mo, pero hindi na ako
kumuha dahil mayroon na siyang pampunas kay baby Roselyn,
sabay sabi saakin tara Angel, sabay akbay sa kanang balikat ko at
kinuha niya ang kumot at pinahiga ako sa kama at kinomutan,
pagkatapos nag hubad na ng shorts si kuya Robert pagkatapos
pumasok siya sa loob ng kumot at ako naman ang kaniyang
hinubaran ng shorts at panty at sabi niya huwag daw ako matakot
tapos pinasok na ni kuya Robert ang ari niya sa ari ko habang
nakatutok ang kutsilyo saakin pagkatapos tinanong niya ako kung
masakit ba? Sabi ko Oo at sabi niya dahan dahanin ko lang at
huwag kang maingay at huwag kang magsusumbong kay mama
mo, pag nag sumbong ka papatayin kita pati mama at ate mo.

si papa Robert kay ate Angel at gumagalaw ang kumot at ng
nakita ako ni papa Robert sinabi niya sakin umalis ka nga diyan
Ale at maya-maya inutosan niya akong kumuha ng kutsilyo at
ibinigay ko kay papa Robert at lumabas na ako ng kwarto.

I. AUTHORITY:

1. WCPD Police Blotter Entry No. dated March 8, 2021; and

II. MATTERS INVESTIGATED:

3. To determine whether or not a violation of the pertinent provisions of RA

8353 has been committed by the herein suspect and would warrant the filing of
necessary charges against the suspect.
4. To dig deeper the extent of the criminal liabilities of the suspect hereof.

III. FACTS OF THE CASE:

5. That on or about 9:00 o’clock in the morning of March 8, 2021, Letecia

Bilugan y Combo, 41 years old, married, businesswoman and a resident of Purok 6,
Brgy. Urdaneta, Lavezares, Northern Samar personally appeared this office together
with her daughter Angel Bilugan y Combo, 17 years old, female, single to record in the
police blotter that her daughter Angel was sexually molested/raped by her live-in
partner Robert Edic y Flores, 38 years old, male, mechanic and a resident of the
aforesaid place by ng her daughter’s (victim) lips and inserting his penis into her
vagina.

6. As per interview conducted upon the mother of the victim Letecia Bilugan y
Combo she disclosed that her daughter told her that she was raped by her step-father
Robert Edic (suspect) while they were in the farm, she was dragged to the cotton fruit
tree and there kissed her lips and took off her short and panty and inserted his penis to
her vagina.

9. Based on the Affidavit of the victim Jhoana Rose, she narrated that she was
sexually molested by her Stepfather @ Longlong five (5) times. The first time she was
raped by her stepfather was on May she forgot the date when her mother went to
Guinapundan Eastern Samar to vote, suspect put shampoo on her vagina and on his
penis as lubricant and inserted his penis to her vagina. And when they were in the farm
to get some cotton fruit, she was dragged to the cotton fruit tree and there took off her
short and panty and inserted his penis to her vagina. After that the next time she was
raped by her stepfather @ LOnglong (suspect) when they are in the farm harvesting
coconut tree to make copras, suspect brought her to the nipa hut and there raped her
and ask her if it felt good and she answered no but still her papa @ Longlong raped
her.

IV. DISCUSSION:
10. Art. 266-A. Rape: when and how Committed - Rape is committed:

1.) By a man who has a carnal knowledge of a woman under of any of the
following circumstances:

a. Through force, threat or intimidation;

b. When the offended party is deprived of reason or is otherwise

unconscious;

c. By means of fraudulent machination or grave abuse of authority;

d. when the offended party is under 12 years of age or demented,

even though none of the circumstances above mentioned above be
present.

11. That based on the evidence gathered, raped was committed by the suspect
for willfully, feloniously and by use of decisive words to successfully have carnal
knowledge with the victim, by means of threatening words from the suspect.
That the result of the medico-legal/anogenital findings revealed that there is a
blunt force or penetrating trauma.

V. CONCLUSION:

12. In the light of the foregoing, the pieces of evidence gathered by the WCPD
investigator are more than sufficient to file a case the herein suspect for Statutory Rape.

VI. RECOMMENDATION:

13. Wherefore, after careful examination of pieces of evidence at hand, it is

hereby recommended that a case for Statutory Rape, be referred before the
Prosecutor’s Office, Allen, Northern Samar against the herein suspect Ramil Rosel y
Barreda.

FACTS OF THE CASE:
Reporting person personally appeared to this police office requesting to put into
police blotter that she was sexually molested/raped by the suspect by forcibly having
sexual intercourse with her. Reportee added that she was threatened by the said
suspect saying in vernacular word “pag magdemanda ka ngan magpa blotter ka sa pulis
patayon ta ikaw”.

In relation to preceding blotter entry no. 0093, suspect Jason Dupan y Enolva
together with her mother personally appeared this police office to clear his name
alleging that he was not involve and that he did not commit the crime that he is being
accused of, But since, the victim was at the station and positively identified the suspect
the one who molested her and the result of the medical examination with positive
presence of sperm cell. Immediately WCPD investigator on case appraise the suspect
of his constitutional rights under arrest. Hence, said suspect is now under the custody of
this station for proper dispositive action.
