. 1. Reference: Spot report on Frustrated Murder Incident dated September 30,2014.

2. This pertains to the Frustrated Murder incident that transpired in El PuebloDe


l Rio Subdivision, Barangay Caypombo, Santa Maria, Bulacan at around 9:10 in theevening of
September 30, 2014. Be informed that the victim PO1 Execel Esteban Y Botac isassigned at
Police Station 6, Barangay Batasan, Congressional Avenue, Quezon City andthe Logistics
Support Service (LSS) was his previous assignment. Said victim is nowconfined or under
medication at Philippine National Police General Hospital, Camp Crame,Quezon City.

3. The victim Carmelito Estacio Y Pangot died while undergoing treatment atE
ast Avenue Medical Center, Quezon City on October 1, 2014. The immediate cause of hisdeath
was gunshot wound to the neck, head and trunk.

4. Interview conducted on one of the neighbor of PO1 Esteban identified asJesu


s Calsedo y Nueva revealed that there were two sets of Fired Cartridge Cases (caliber9mm and
caliber .45) scattered on the road which were picked-up by bystanders after theincident.
According to him he was even able to pick one fired cartridge case.

.FACTS OF THE CASE:

(SHOOTING INCIDENT): One ARJE CABANGUNAY Y GULMATICO, 30 years old,


married, of Brgy. Poblacion Catbalogan Samar, appeared this station and reported that he
was allegedly shot by the Security Guard of Paradise Park on or about 3:00 p.m. this date.
Victim sustained gunshot wound on the right back shoulder.

Entry Nr. 09- 1139/29 Sept 02/4:20PM: Person of Arje Cabangunay y Gulmatico
Appeared this office and reported that the suspects who shot him was NESTOR LABERON

09- 1141/29 Sept 02/5:00PM: (RE: 091135): Initial investigation conducted by this
station at the place of incident disclosed that Security Guard of Banahaw Security Agency,
One was posted at a parcel of the land adjacent to Paradise Park, Brgy. Poblacion Catbalogan
Samar, wherein more or less 50 families living said place was allegedly harassed
by member of said Security allegedly fired his firearm hitting, as per interview with the residents
of said Park identified ARJE CABANGUNAY Y GULMATICO, 30 years old, married, hitting
him on the right back shoulder of unknown caliber of gun and JOHN RAYESTRELLES Y
NUEVA, 37 years old, single also of Paradise Park. On the contrary during interview by PO3
GANN JAIRO L. PUERTULLANO with the Security Guard that was allegedly attacked by
the residents of Paradise Park. Victim ARJE CABANGUNAY Was treated of gunshot wound at
Abasolo Clinic but later transferred to Samar Provincial Hospital for further treatment JOHN
RAY ESTRELLES was brought to undisclosed hospital. Incident occurred on or about 3:00PM
this date. Catbalogan City, Samar, 03 October 2002
