Affidavit of Complaint

Police Inspector Joy Melvin Catubig Dulce witnessed SPO3 Maquera walking zigzag and holding a baseball bat in front of the Silang Police Station. When confronted by other officers, Maquera shouted insults and proceeded to hit the patrol car 6 times with the bat. He was arrested and found to be intoxicated based on a medical examination. Inspector Dulce filed an affidavit to support administrative and criminal charges against Maquera for deliberately damaging government property while intoxicated.

AFFIDAVIT OF COMPLAINT

I, Police Inspector JOY MELVIN CATUBIG DULCE of legal age,


single, Filipino, presently designated as Deputy Chief of Police,
Silang City Police Station with mailing address at Brgy. Tartaria,
Silang City, Province of Cavite. After having duly sworn to in
accordance with the law hereby depose and state:

I was instructed by my Chief Of Police, Police Captain Juan De Cruz


of this police station to conduct inspection and verification regarding
the readiness of the member this police station for any eventuality or
occurrence of crime last September 14, 2014.

On or about 1900H 15 September 2014 at Foxtrot Substation of


Silang, Cavite, I saw SPO3 Charles Kenneth Maquera, holding a
baseball bat while walking zigzag in front of Silang Police Station,
then I instructed SPO1 Roberto Nguso and SPO2 Dario Tabo to talk
to SPO3 Maguera relative to his actuation.

During the confrontation between SPO3 Maguera, SPO1 Nguso


and SPO2 Tabo, I heard a loud voice of SPO3 Maguera saying “ Mga
gago kayo, Wala akong pakialam sa inyo”. Suddenly, SPO2 Maguera
hit the Patrol Car with Body Number 223 with baseball bat more or
less 6 times.

Immediately, SPO1 Nguso and SPO2 Tabo arrested SPO3


Maguera and brought him in nearest hospital for examination and
found out that he is positive in Alcoholic Breath as certified by Dr.
Jose Lazaro of Silang Medical Center, Silang Cavite.

I told to SPO1 Nguso and SPO2 Tabo to turn over SPO2 Maguera
to Criminal Investigation Section for filing of Criminal and
Administrative Charge against SPO2 Maguera. and execute an
affidavit to support the appropriate case against SPO3 Maguera.
That, I execute this affidavit to attest to the truthfulness of the
foregoing facts and for the purpose of filing an administrative
complaint against SPO3 Charles Kenneth Maquera for GRAVE
MISCONDUCT as stated in NMC- 2016-001 Rule 21, Sec 2 para-C
sub-para 3n “deliberately or through gross negligence, destroy,
damage or lose government property entrusted to him for official use”.

That, further I hereby declare under oath that this complaint is not
a form of harassment or retaliation and the supporting
evidence/documents herein are authentic and from verifiable source
and fully aware of the consequence of being held liable for perjury in
case of false or misrepresentation in this affidavit.
