No. 40,00,0000.016.32.021.13.30 Bangladesh Labor Law, 2006 (Act No. 42 of 2006) By virtue of sub-
section (1) of section 140, the Government under section 139 of the said Law 'Garments' 'Industrial Sector,
hereinafter referred to as the said Industrial Sector, hereby declares the minimum rates of wages specified
in the following schedule recommended by the Minimum Wages Board for its workers and employees,
subject to the following conditions, as the minimum rates of wages for the workers and employees of the
said Industrial Sector respectively. , that is:-

(a) The probationary period for a worker is 3 (three) months. However, it is conditional that a worker's
probationary period may be extended by an additional 3 (three) months if, for any reason, it is not possible
to assess the quality of their work during the initial 3 (three) months' probationary period.
(b) Upon completion of the probationary period successfully, the probationary worker will be appointed
as a permanent worker at the relevant grade.
(c) During the probationary period, a probationary worker will receive a monthly total of 9875/- (Basic
Salary 4950/-, House Rent at a rate of 50% of basic salary 2475/-, Medical Allowance 750/-, Transport
Allowance 450/-, and Food Allowance 1250/-).

(b) on the satisfactory completion of the probation period the probationary assistant will be appointed as
a permanent worker in the grade concerned; And
(c) During the probationary period, a probationary assistant will receive a monthly total of 9950/- (Basic
Salary 5000/-, House Rent at a rate of 50% of basic salary 2500/-, Medical Allowance 750/-, Transport
Allowance 450/-, and Food Allowance 1250/-).
Conditions:
1. The minimum wage rates mentioned in Schedule-A and Schedule-B shall be applicable to the
"Garments" industry sector of all areas located in Bangladesh.
2. Any posts in addition to those mentioned in Schedule-A and Schedule-B pre-existing in the
concerned industry or added subsequently shall be included in the respective category/grade.
3. In the schedule 'A' of the said industrial sector, the workers in the grade in which they are
currently working are grade-1, grade-2, grade-3 and grade-4 respectively in the new gazette
instead of grade-3, grade-4, grade-5 and grade-7 in the previous gazette. Considering them as
Grade-4, their wages shall be determined in coordination with this wage structure. After 01 (one)
year of service after adjustment, the annual salary will be increased at the rate of 5% of the basic
salary. No worker shall be downgraded.
4. Following the proposal of various labor organizations, the previous grade-6 was dropped and the
workers of that grade have to be replaced in the new grade-3. In that case the "General"
designations will be promoted as "Junior" designations.
5. The workers mentioned in schedule 'B' of the said industrial sector shall be replaced in the grade
in which they are currently working and their wages shall be fixed in coordination with this wage
structure. No employee shall be downgraded.
6. Grade-I: Pattern Master, Chief Quality Controller, Chief Cutting Master/Cutting Chief, Chief
Mechanic and Grade-II: Mechanic/Electrician, Cutting Master posts in Schedule 'A' of the former
Gazette fall in the grade of Officers and they receive a salary several times higher than the
minimum wage. Due to this, the posts along with their grades have been removed from the
current gazette. However; 2(65) of the Bangladesh Labor Law, 2006 if the persons working in the
said posts are not assigned with administrative, supervisory or managerial duties, they shall be
treated as laborers and their wages shall in no way exceed the current Grade-I of Schedule 'B'. It
will not be less than the wages.
7. In view of this schedule, after the announcement by the government, the owners of the said
industrial sector shall enter the workers in the appropriate grade according to the class division
and position mentioned in the schedule and provide the wage slip by entering the wage register.
8. The wages mentioned in Schedule-A and Schedule-B shall be considered as the monthly minimum
wages of the concerned workers and the wages shall not be lower than the said minimum wages,
but if the wages are paid at a higher rate than the said minimum wages, it shall not be reduced.
9. The employer or the owner may pay a higher rate of wages to any worker-employee or workers-
employees as per the agreement executed on self-employment or sole or joint venture.
10. If a worker is employed in the said industrial sector and receives wages through a contractor, the
said worker will also be considered a 'worker' as per Section 2(65) of the Bangladesh Labor Law,
2006. In the said industrial sector, if any problem arises in respect of dues owed by any worker to
the contractor, his responsibility will fall on the owner. The contractor shall in no case pay wages
less than the minimum wage declared by the Government for the worker.
11. The hiring contractor mentioned in condition (10) shall take similar measures as the owner in
accordance with the provisions of Section 121, Section 150 and Section 161 of the Bangladesh
Labor Law, 2006.
12. If the owner of the said industrial sector has been paying piece rate wages to the workers
employed in sweaters and other "garments" industrial sectors, then the rates mentioned in the
schedule and subject to the above-mentioned conditions shall be revised to such a rate that they
are the minimum wages prescribed for various categories of workers don’t be underpaid.
13. In addition to the minimum wages and various allowances mentioned in the schedule, all the other
rights, facilities and allowances that the workers are getting in the working establishments will
remain in force and continue as per the provisions of the relevant section of the Bangladesh Labor
Law, 2006.
14. After 01 (one) year of service by adjusting the minimum wages mentioned in this schedule, the
wages of the employees will be increased at the rate of 5% of the basic wages on an annual basis.
In subsequent years, the incremental rate will increase again at the rate of 5% of the basic wages.
Workers working on piece rate wages in sweaters and other 'garments' industry sectors will also
get the benefit of wage increase at the rate of 5% of the basic wages on an annual basis.
Explanation: If the basic wages of a worker is 6,700/- (six thousand seven hundred); However, after
working for one year, his annual salary will be increased and the basic salary will be fixed at Tk
7,035/- (seven thousand and thirty-five). In subsequent years, the cumulative rate will increase
again at the rate of 5%. That is, the basic wages of 7,035/- (seven thousand and thirty-five) will be
increased by 5% to 7,386.75/- (seven thousand three hundred and eighty-six and seventy-five
paisa).
15. The workers employed in the said industrial sector shall be entitled to allowances and other
benefits as per the relevant clauses and rules of Bangladesh Labor Law, 2006 and Bangladesh
Labor Rules, 2015.
16. The working hours of the workers will be determined according to the relevant clauses and rules
of Bangladesh Labor Law, 2006 and Bangladesh Labor Rules, 2015.
17. If any matter mentioned in this announcement is in conflict with Bangladesh Labor Law, 2006 and
Bangladesh Labor Rules, 2015, that part shall be considered void.
18. This announcement shall come into effect from 16 Agrahayan 1430 Bengal, corresponding to 01
December 2023 AD.
