THREE (3) TRAFFIC LAW ENFORCEMENT ACTIONS

I. Traffic Arrest – It is an enforcement action for purpose of holding or detaining a


driver to answer a charge of violation of traffic law before the court.

Instances leading to traffic arrest

1. Involvement in accident;
2. Driving without driver’s license in his person;
3. Refusal of driver-violator to surrender his/her driver’s license upon demand of
authorized traffic management operative or law enforcer.

(Exemption from the rule of Confiscation of Driver’s license (RA 4136 and A.O. from
LTO)
 If the driver’s act resulted in damage to property;
 If the driver’s act resulted in Physical Injury;
 If the driver’s act resulted in Homicide; and
 If the driver committed a crime while using a vehicle.

Ask about impounding of vehicle

II. Traffic Citation – Common enforcement action by a traffic enforcer. This is a minor
violation committed commonly reflected in the TVR.

III. Traffic Warning – Actions which does not contemplate possible assessment of
penalty. Usually produces positive attitude from the violators.
 Visual Warning
 Written Warning
 Verbal Warning

FUNDAMENTALS OF TRAFFIC MANAGEMENT ON INVESTIGATION

Definition of Terms:

 Management – skillful use of means to accomplish a purpose


 Operation – a course or series of action to effect a certain purpose, manner of action
or a vital or natural process of activity.
 Roadways/Highway – part of the traffic way over which motor vehicle pass.
 Shoulder – either side of the roadway, especially along highway. (1 ½ meters to 2
meters)
 Traffic – movement of persons, goods or vehicles either powered by combustion
system or animal drawn from one place to another.
 Traffic Way – entire width between boundary lines of every way or place of which
any part is open to the use of the public for purposes of vehicular traffic as a matter
of right or custom.
 Traffic Safety Education – process of training road users in the avoidance and
prevention of traffic related accidents.
 Road Safety – reduced risk of accidents or incident or injury in the roads achieved
through multi-disciplinary approaches system involving roads & roadside safety, road
users’ safety, vehicle safety and vehicle speed safety. Road safety is shared
responsibility.
