The following are the results of the preliminary review of the case conducted by this
Office:

FINDINGS

1. The following documents required under the pertinent rules of this Department
were not submitted:
Original copy of the Special Power of Attorney executed by HEIRS OF
VICENTA T. RAMULTE in favor of AMUERFINO E. CINCO

Certified true copy of the CLOA sought to be cancelled specifically:


o OCT no. 00-11904 bearing CLOA no. 00138270
Photographs of the Notice posted on the bulletin board of the Barangay
Hall and installed at a conspicuous location along the premises of the
landholding

2. The Provincial Agrarian Reform Adjudicator (PARAD) failed to submit the


Barangay certificate of posting of the required Notice.

DIRECTIVES

1. The Petitioners must submit to the PARAD the photographs of the billboard
installed along the premises of the subject landholding within fifteen (15) days
from receipt hereof.

2. The PARAD to submit the photographs of the Notice posted on the bulletin
board of the Barangay Hall within fifteen (15) days from receipt hereof.

3. The abovementioned Petitioners must submit a signed and notarized Special


Power of Attorney to the PARAD within fifteen (15) days from receipt hereof.

4. The PARAD must submit the Barangay certificate of posting of the required
Notice within fifteen (15) days from receipt hereof.

Failure of the Petitioners to comply with the abovementioned directives, specifically


Directives number 1 and 3, shall be a ground for the dismissal of the Petition without
prejudice.

Let the records of this case be remanded to the PARAD of Leyte to facilitate further
reception of documentary evidence and case build-up in accordance with existing rules
and administrative orders of this Department, and to avoid unnecessary duplication of
documentary evidence.
