AFFIDAVIT OF ARREST

I, PMAJ MARVIN JORDAN OBILLO LAROYA, of legal age,


married, a resident of Barangay Linapew, Tubao, La Union after having
duly sworn to in accordance with law do hereby state and depose the
following, to wit;

1. THAT: the undersigned is presently assigned at Silang


Municipal Police Station, Silang Cavite, as Chief of the Drug Enforcement
Unit of Silang Police Station,

2. THAT: on or about 5:00 in the morning of February 21,


2022, I was at the Police Station, while doing some paper works, when my
attention was called by PAT KULANGOT NA DE MATAE, who is also a
member of the Silang Police Station, informing me that there is a
suspicious man in front of 711 convenience store located at Barangay
Matahimik, Silang, Cavite,

3. THAT: because the said place and the said convenience


store had records of robbery incidents, I immediately directed the mobile
patrol section who at the time being crewed by PAT SUNGAL and PAT
KUPAL ULET, to check the said report and report to me the result of their
action,

4. THAT: on or about 5:15 in the morning of February 21,


2022, PAT Sungal called through our radio, informing the undersigned that
the report is positive and the male person being reported is allegedly
armed with an unidentified caliber of firearm,

5. THAT: immediately after I received the said information, I


immediately directed some of my men composed of, PAT ANTUKIN, PAT
DOOZING, PAT TULO LAWAY and PAT MUTAIN to go to the place
where PAT SUNGAL and PAT KUPAL ULET were located responding to
the alleged armed male suspect,

6. THAT: I with the aforementioned police officers reached


the place where the alleged armed male person is hiding, and directed my
men to tactically position themselves in such a way that in the event of
armed confrontation, we could protect ourselves from possible attack the
said male person will undertake,

7. THAT: with the use of megaphone, I immediately directed


the said armed male person to peacefully surrender while identifying
ourselves as members of Silang Municipal Police Station,

8. THAT: at about 5:45 in the morning of February 21, 2022,


the said armed male person suspect went out from the place he was hiding
and peacefully surrender a .38 caliber revolver loaded with six live
ammunitions,

9. THAT: suspect was immediately placed under arrest and


bodily searched for possible concealment of any contraband, wherein while
I was conducting bodily search to the said male suspect, I was reciting his
constitutional rights as part of the Standard Operating Procedure in placing
a person under arrest,

10. THAT: during the search, I was able to confiscate from his
right pocket, a small container which when I examined, said plastic
container, contains a small heat-sealed sachet with white crystalline
substance suspected to be illegal drugs,

11. THAT: in view of the said confiscation, I immediately


directed PAT SUNGAL to summon Barangay Officials of the place where
the arrest was made, for the purpose of witnessing the said confiscation of
suspected illegal drugs in compliance with Section 21 of Republic Act 9165,
12. THAT: on or about 6:00 in the morning of February 21,
2022, a certain Barangay Chairman Malaki tiyan Panget pa, arrived
together with some Barangay tanods and there I immediately explained to
them the purpose of the request or invitation to witness the markings of
the said confiscated evidence,

13. THAT: in the presence of the witnesses, the following


items were carefully marked to wit;

a. One (1) .38 caliber revolver with no serial number which the
undersigned marked as “MJL-1”,

b. Six (6) .38 caliber ammunitions which I marked as MJL-2,


MJL-3, MJL-4, MJL-5, MJL-6 and MJL-7,

c. One (1) plastic container measuring 1x2 inches with markings


“DEODORANT” which I marked as MJL-8,

d. One (1) heat-sealed plastic sachet containing white crystalline


substance suspected to be illegal drugs which I marked as MJL-9,

14. THAT: the said items after they were formally marked
were photographed and duly inventoried in the presence of the witnesses
and the suspect himself whom we later come to know the name as
PEDRONG TANGA y ADIK PA, 24 years old, jobless, married, a resident
of Barangay Matahimik Silang, Cavite,

15. THAT: a receipt for the items seized were issued to the
suspect himself and a copy was also provided to the witnesses for their
own record and reference, (Note: the suspect refused to sign, while the
witnesses voluntarily affixed their signatures in the receipt acknowledging
the same as true and faithful inventory of the items seized)
16. THAT: suspect was immediately brought to the police
station for proper disposition while the seized items were properly turned
over to Pat Imbestigador na Hindi Tanga, covered with appropriate receipt
of Chain of Custody of Evidence as hereto attached,

17. THAT: suspect after having been properly booked and


photographed was later brought to Funeraria Medical Center for Medical
and Physical Examination wherein after the medical examination, suspect
was eventually turned over to the custody of the BJMP duly received by
JO1 PALAGING TULOG,

18. THAT: the undersigned hereto affix his signature below


this 21st day of February 2022 at Silang, Cavite, Philippines.
