AFFIDAVIT OF DESISTANCE

I, JERSON CHIONG, of legal age, Filipino, and a resident of Davao City,


Philippines, after having been duly sworn in accordance with law, hereby depose
and say:

1. That I am the legal representative of AT THE DRIVE IN , INC., and


MARS VOLTA MARKETING who are the complainants in Criminal Case
No. 366,112-18 for qualified theft entitled People of the Philippines vs.
Elliot Davis, now pending before the Regional Trial Court, Branch 49,
Davao City;

2. That I am also one of the witnesses for the prosecution in the said case;

3. That the accused, Elliot Davis has promised to pay the amount of
P18,000.00 to be taken from his cash bond that he posted for his provisional
liberty;

4. That in view of the payment in full by the accused, I would like to manifest
that I, as well as my principal complainants, are no longer interested in the
prosecution of the aforementioned criminal case.

5. That I as well as other witnesses in this case are likewise desisting from
testifying against the accused.

6. That I will respectfully request for the dismissal of the case against the
accused, Elliot Davis;
