AN ACT INSTITUTING A COMPREHENSIVE AGRARIAN REFORM PROGRAM TO PROMOTE


SOCIAL JUSTICE AND INDUSTRIALIZATION,PROVIDING THE MECHANISM FOR ITS
IMPLEMENTATION, AND FOR OTHER PURPOSES.

CHAPTER I – PRELIMINARY CHAPTER

SECTION 1: Title

• This Act shall be known as the Comprehensive Agrarian Reform Law of 1988.

SECTION 2: Declaration of Principles and Policies

• Establishes the Comprehensive Agrarian Reform Program (CARP) to promote


social justice.
• Ensures equitable land distribution with fair compensation to landowners.
• Farmers and farmworkers have the right to own or receive a fair share of the land
they till.
• Government shall provide support services such as financing, technology, and
infrastructure.

SECTION 3: Definitions

• Agrarian Reform – Redistribution of lands, regardless of crops or fruits produced, to


farmers and regular farmworkers who are landless, irrespective of tenurial arrangement,
including support services and alternative arrangements like production or profit-
sharing, labor administration, and distribution of stocks.
• Agriculture, Agricultural Enterprise, or Agricultural Activity – Cultivation of soil,
planting of crops, growing fruit trees, raising livestock, poultry, or fish, including
harvesting and other farm activities performed by a farmer.
• Agricultural Land – Land devoted to agricultural activity and not classified as mineral,
forest, residential, commercial, or industrial land.
• Agrarian Dispute – Any controversy related to tenurial arrangements (leasehold,
tenancy, stewardship) over agricultural lands, including disputes on compensation,
farmworkers’ associations, and terms of ownership transfer.
• Idle or Abandoned Land – Agricultural land that has not been cultivated, tilled, or
developed for any crop or economic purpose for at least three (3) years prior to the
government's notice of acquisition, except land rendered unproductive due to force
majeure.
• Farmer – A natural person whose primary livelihood is cultivating land or producing
agricultural crops, either by himself or with the assistance of his immediate farm
household, regardless of land ownership.
• Farmworker – A natural person employed in an agricultural enterprise or farm,
regardless of wage basis. Includes workers affected by agrarian disputes.
• Regular Farmworker – A farmworker employed on a permanent basis by an
agricultural enterprise or farm.
• Seasonal Farmworker – A farmworker employed on a periodic or intermittent basis,
such as "dumaan" or "sacada."
• Other Farmworker – A farmworker who does not fall under regular or seasonal
categories.
• Cooperatives – Organizations of small agricultural producers, farmers, or farmworkers
who pool resources for economic activities, operating on a one-member, one-vote
principle.

CHAPTER II – COVERAGE

SECTION 4: Scope

• CARP covers all public and private agricultural lands suitable for farming.
SECTION 5: Schedule of Implementation

• The land distribution program shall be completed within ten (10) years.

SECTION 6: Retention Limits

• Landowners can retain up to five (5) hectares.


• Each child of the landowner (if at least 15 years old and tilling the land) may own
up to three (3) hectares.

CHAPTER IV – REGISTRATION

SECTION 14: Registration of Landowners

• Requires landowners to register their agricultural lands with the Department of


Agrarian Reform (DAR).

SECTION 15: Registration of Beneficiaries

• Identifies qualified agrarian reform beneficiaries (tenants, farmworkers, and


landless farmers).

CHAPTER V – LAND ACQUISITION

SECTION 16: Procedure for Acquiring Private Lands

• The DAR notifies landowners of land acquisition.


• The government offers compensation based on market value and tax
assessments.
• If the landowner rejects the offer, DAR conducts hearings to determine
compensation.
• Once payment is made, the land is transferred to agrarian reform beneficiaries.
CHAPTER VI – COMPENSATION

SECTION 17: Determination of Just Compensation

• Compensation is based on:


o Acquisition cost
o Market value of similar properties
o Land use and productivity
o Owner’s valuation and tax declarations
• Unpaid taxes or loans affect valuation.

SECTION 18: Valuation and Mode of Payment

• Compensation options:
o Cash payments (percentage depends on land size).
o Land Bank bonds with market interest rates.
o Stock shares, tax credits, or physical assets.

SECTION 19: Incentives for Voluntary Sale

• Landowners voluntarily selling land receive an additional 5% cash payment.

SECTION 20: Voluntary Land Transfer

• Landowners may directly transfer their land to beneficiaries under DAR


supervision.

CHAPTER VII – LAND REDISTRIBUTION

SECTION 22: Qualified Beneficiaries

• Land is distributed to landless residents of the same barangay or municipality.


• include:
o Tenants and farmworkers
o Actual tillers
o Cooperatives and farmer organizations

SECTION 23: Land Ownership Limits

• No beneficiary can own more than three (3) hectares.

SECTION 24: Award Process and Land Titles

• Land ownership is granted through a Certificate of Land Ownership Award (CLOA).

SECTION 25: Collective Ownership Land Bank in 30 annual installments at 6% interest


per year.

• Farmer-beneficiaries may choose collective ownership through cooperatives.

SECTION 26: Payment by Beneficiaries

• Payment is made to Land Bank in 30 annual installments at 6% interest per year.


• Payments cannot exceed 10% of annual gross production.

SECTION 27: Land Transfer Restrictions

• Land cannot be sold, transferred, or mortgaged for ten (10) years.
