Procedure for applying for Mining Lease or Composite

License or Reconnaissance Permit


W.r.t. Major Minerals that can be dispensed through public auction calling NITs through online.

Mining Leases / Composite License / RPC (Reconnaissance Permit) including their


Renewals

W.r.t. Minor Minerals

 The applicant has to identify the area applied for


 The mineral also identified by the applicant. Later minerals are categorized depending on
the usage and other distinguishes categorized as follows:

1) Minerals used for construction and other purposes, minor minerals like Road metal,
Gravel, Slate, Lime concur, Mosaic chips and Limestone slabs(Color and Black) etc.
2) Minerals useful for decorative purpose and recently converted into Minor Minerals from
Major category which are useful in industrial purpose viz. Granite Marble and 31
minerals.

Procedure to apply for grant of Leases

Category 1

Applicant shall apply in the form prescribed in FORM B by duly paying a fee of Rs. 5000 as
application fee, Rs. 500 as Survey charges and deposit amount of Rs. 10,000 per hectare. All
payments are in the form of challans.

The applicant shall enclose the surveyed plan in the scale map of the area proposed to
apply.

Applicant also need to enclose an affidavit showing the details of leases already having by
him/them and the applications filed and pending. If the applicant already having leases are upload
the copy of MDCC stating that no dues to the government.

Category 2 (Granite, Marble … 31 minerals)

Applicant having provision to apply as Prospective License application. In FORM N:


Prospective license by paying application fee of Rs. 10,000, Survey Charge Rs. 2500 and deposit
amount of Rs. 25,000 per hectare.

For the grant of quarry lease, they have to apply in FORM P.

The enclosures are scaled map duly certified by the licensed surveyor together with the
applicant.

Applicant also need to enclose an affidavit showing the details of leases already having by
him/them and the applications filed and pending. If the applicant already having leases are upload
the copy of MDCC stating that no dues to the government.
The applicant also shall submit financial status in the form of IT return of the last 3 years.

Processing of Application

Soon after of receipt of application in any category the ADM&G forward the same to the
Thasildar of the concerned Mandal seeking the classification and availability. (NOC)

After receipt of NOC, the applied area can be inspected by the ADM&G or staff along with
Surveyor for demarcation of the area.

ADM&G submitted proposals to DDM&G in case of Category 1 minerals. DM&G in case of


category 2 minerals.

DDM&G or DM&G issue letter of Intent (LOI) to the applicant requesting to submit Approved
Mining Plan (AMP), Environment Clearance (EC) and Consent for Establishment (CFE).

After the receipt of above from the applicant, DDM&G / DM&G can issue grant orders
granting the lease.

ADM&G shall execute the lease within 90 days from the date of grant in case of Category 1
minerals and 60 days in case of Category 2 minerals.

The DM&G having provision to grant extension of time each 30 days twice.

After execution of lease, the Lessee (Lease Holder) shall submit Consent for Operations
(CFO) before the commencement of quarry operations or within 6 months from the date of grant for
category 1 minerals and 2 years from the date of grant for category 2 minerals commence the quarry
operations.

Renewal of Quarry Leases

Category 1 minerals

Renewal process are one and the same as mentioned in the original grant of lease.

Category 2 minerals

Applicant shall apply in FORM Q duly paying Rs. 10,000 as application fee. The affidavits and
other docs are one and the same as N & P.

The enclosures are scaled map duly certified by the licensed surveyor together with the applicant.

Applicant also need to enclose an affidavit showing the details of leases already having by
him/them and the applications filed and pending. If the applicant already having leases are upload
the copy of MDCC stating that no dues to the government.

W.r.t. renewal category 1 minerals the application format is FORM B already stated in …
there is no deviation.

He has to apply before 90 days from the date of expiry.

Category 2 apply before 1 year of the date of expiry.


Transfer of Leases

Transfers can be allowed for both category of minerals.

a) In case of leases granted for Individual/Firms/Companies, transfer of total lease can be


allowed for the purpose of captive with a condition to pay the fee of Rs. Equal to 10
years dead rent or the dead rent of the balance lease period whichever is higher. They
have to apply in FORM R duly paying a fee of Rs. 5000 for category 1 mineral and Rs.
10,000 for category 2 mineral in FORM R
b) Adding of partners / directors and change of individual to partners / Firm /Companies
can be allowed with a condition. The original lease holder / partners/ directors retained
51% of their voting share and apply in FORM R1 by duly paying a fee of Rs. 5000 in case
of category 1 minerals and Rs. 10000 in case of category 2 minerals with a condition they
have to pay 2 times of the dead rent as transfer charges.
