Contract of Lease
This CONTRACT OF LEASE, made and entered into in the Municipality of Daet, Province of
Camarines Norte, by and between, to wit:
MRS. NORA C. SURETA, likewise of legal age, Filipino, a resident of Bagasbas Road, Barangay VI,
Daet Camarines Norte, and hereinafter called the LESSOR;
EMMANUEL PAYMOND PARDO OSEA, likewise of legal age, Filipino, residing at Daet, Camaries
Norte and hereinafter called the LESSEE;
WITNESSETH:
WHEREAS, the LESSOR is the owner of an apartment for rent located along Bagasbas Road,
Barangay VI, Daet, Camarines Norte, and the LESSEE wanted to occupy and lease one (1) door/unit
thereof from the LESSOR;
NOW THEREFORE, for and in consideration of the foregoing premises and based upon mutual
covenant, stipulation and agreement hereinafter provided, the LESSOR hereby let and leases unto the
LESSEE ONE (1) DOOR / UNIT of the said apartment, subject to the following terms and conditions to
wit:
1. TERM OF THIS LEASE: The term this lease shall be ONE (1) YEAR starting from JULY 1, 2020 and
to expire automatically without need any notice or demand at 12:00 noon on JULY 1, 2021. No
renewal or extension shall be allowed unless the LESSOR executes a written renewal or
extension at least thirty (30) days prior to expiration , otherwise, the premises shall be deemed
vacant subject to the free disposal of, and occupancy by, the LESSOR and / or representative;
2. LEASES OR RENTAL: Rental shall be SIX THOUSAND PESES (₱ 6,000) PHILIPPINE CURRENCY, per
month which shall be paid and remitted in advance within the first five (5) days of the month
starting from the date hereof and every fifth day of the month thereafter without need of any
further notice or demand directly to the LESSOR and / or representative;
3. SECURITY DEPOSIT: That the LESSE upon execution of this deed shall pay a “security deposit”
equivalent to two (2) month rental top answer for any unpaid bills for light, water and other
payables and damages left unpaid upon surrender of the premises. Current rentals shall not be
charged to this security deposit;
4. BILLS FOR LOGHT AND WATER AND OTHER UTILITY SERVICES: All bills for light and water and
other utility services placed, installed and / or used in the leased premises shall all be charged to
the exclusive expense and account of the LESSEE up to the date the premises is finally vacated
or surrendered.
5. CONDITION IF THE LEASE PREMISES: The LESSEE hereby acknowledge that the premises subject
of this lease is in good, clean and tenantable condition and agree to keep it in such good, clean
and tenantable condition up to the termination of this lease and / or surrender thereof to the
LESSOR and / or representative may inspect the premises on any reasonable hour of the day or
night to ensure compliance of this provisions;
6. IMPROVEMENTS, ALTERNATION OR RENOVATION: The LESSEE is prohibited from making or
introducing any improvements, alternations or renovations on the leased premises and / or on
any part or portion thereof without the “prior written” approval of the LESSOR PROVIDED,
however, that notwithstanding the written approval or consent given by the LESSOR, any
improvements alterations and / or renovations made and / or introduced in the premises shall
all become property of the LESSOR who shall have no obligation to pay the value thereof if the
same is permanent and its removal will cause damage or destruction on the leased premises or
any part or portion or portion thereof;
7. SUBLEASE OR TRANSFER OF RIGHTS: The LESSEE shall have no right to sublease the premises
subject of this lease or any part or portion thereof to anybody, nor shall have the right to sell,
convey, transfer or assign the rights hereto acquired without the prior written consent and
approval of the LESSOR. Violation of this provision shall cause the automatic cancellation of this
contract and gives the LESSOR and / or representative the right and authority to occupy the
premises without need of court action or order;
8. PROHIBITIONS: Aside from those already provided for in this contract, the LESSEE is strictly
prohibited from doing and / or cause the doing of any of the following acts: (a). tampering its
electric and / or water meters; (b). making illegal or unauthorized connections in its electrical
and / or water lines; (c). using and / or allowing the use of the any instrument, gadgets or
materials in its electrical or water connections or meters that will be interpreted as theft of
electricity or water consumption; (d). using and / or allowing the use of the leased premises or
any part or portion thereof as pet quarter or for illegal or immoral activity or purpose; (e).
bringing into or depositing / storing in the leased premises any explosives and / or materials,
objects or substance that may cause fire or explosives and / or materials, objects or substance,
objects or materials prohibited by the Government; and (f). install or cause the installation of
any machinery, apparatus or equipment that may cause fire, explosion or increase the fire
hazard of the building;
It is provided that, aside from the LESSOR’s right to cancel this contract, violation of
any of these prohibition shall be the sole concern and responsibility of the LESSEE
who, in addition to his / her liability to the authorities and / or person or entity
concerned, shall be liable for all the DAMAGES suffered by the LESSOR and / or the
premises as a consequence whereof.
9. NON-PAYMENT OF RENTAL OR VIOLATION OF TERM: If the rent herein stipulated or any part
thereof, at any time, be in arrears or not paid as herein provided for two (2) months or the LESSEE
shall at any time fail or neglect to comply with any of the terms, covenants’, conditions and / or
restriction or prohibitions herein imposed, the LESSOR shall have the right to cancel this contract
and demand for the immediate surrender of the premises;
10. COLLATERAL FOR THE PAYMENT OF OBLIGATIONS: Expect consumables, all things or items
owned by the LESSEE brought in the leased premises shall constitute as collateral for the payment of
the obligations herein provided and, therefore, these things or items shall not be removed
thereform without the prior written consent and approval of the LESSOR. Violation of this provision
shall constitute deceit which may subject the LESSEE to criminal prosecution for swindling or estafa
under Revised Penal Code;
11. DAMAGES OR DESTRCUTION OF THE LEASED PREMISES: If the leased premises or portion
thereof be damaged or destroyed through the fault, negligence or makings of the LESSEE and / or its
family, guests, customers, visitors, helper or employees, such damage or destruction shall be the
sole liability, responsibility and concern of the LESSEE who shall pay for the value thereof the
LESSOR;
12. USE OF THE PREMISES: The premises shall be used for dwelling / residential unit only, and no
part or portion thereof shall be used for any illegal or immoral purpose or activity whatsoever.
Violation of this provision shall be the sole concern and responsibility of the LEASE and this shall be
a ground for cancellation of this lease;
13. FAILURE TO SURRENDER THE PREMISES UPON TERMINATION OR CANCELLATION: If the leased
premises be not surrendered upon termination of this lease or cancellation thereof, the LESSEE shall
be liable for any and all the DAMAGES which the LESSOR may suffer by the reason whereof, and
shall also indemnify them for any and all claims succeeding tenants resulting from such delay in the
surrender of the premises;
14. OCCUPANCY AFTER TERMINATION: Should the LESSEE for any reason whatsoever continues to
occupy the leased premises after this lease expire without executing any “written” extension or
renewal of this lease contract signed by both parties, such occupancy, if ever, shall be subject to the
same terms and conditions provided for in this contract, but with respect tp the term however the
same shall be deemed as running on “a month-to-month basis’ only, subject to termination by
either party by giving fifteen (15) days advance notice to the other. Further, occupancy of the leased
premises with or without any written or extension shall be subject to a yearly automatics increase of
TEN PERCENT (10%) in the rentals.
15. NON-WAIVER OF RIGHT: The failure of the LESSOR to insist upon the strict compliance or
performance of any of the conditions or prohibitions herein provide shall not be constructed as a
waiver or relinquishment of the right or remedy that the LESSOR may have against the LESSEE nor
shall it be construed as a waiver of any subsequent breach or default on the terms, conditions or
prohibitions herein provided;
16. COURT ACTION: In case of court action for the enforcement of any of the conditions,
prohibitions or provisions of this contract, the LESSEE, in addition to the damages suffered, shall pay
the LESSOR an amount of not less than ₱ 15,000, Philippine Currency, as Attorney’s Fee, plus
litigation expenses in an amount not less than ₱ 5,000, Philippine Currency;
17. PAYMENT FOR BIR VALUE ADDED TAX: The amount due as BIR Value Added Tax shall be
withheld and shall be paid by the LESSEE directly to the BIR;
18. ADDITIONAL STIPULATIONS: Any and all stipulations, agreements and / or understandings,
verbal or in writing, priorly or subsequently made or entered into or entered into by the parties
inconsistent with, or nor stated nor incorporated to, this contract are all invalid, void, cancelled
and / or unenforceable. Any change, addition, alteration and / or modification/s of any of the terms
and conditions herein set forth shall not be binding unless put in writing and signed by both parties;

ACKNOWLEDGEMENT
BEFORE ME, a Notary Public for and in the Province of Camarines Norte, personally appeared,
namely: MRS. NORA C. SURETA with CTC _______________ issued at Daet, Camarines Norte on
_________________________________ and presented her SSS ID No.: 05-0946629-07 and MRS.
DOLORES ALEGRE with CTC No. ______________________issued at Daet, Camarines Norte on
____________________ and presented her PRC Identification Card No. _______________________ as
proof of their identify, bot known to me personally and to me known to be as the same persons who
executed the foregoing document and they acknowledges that the same is their own free act and
voluntary deed.
SAID INSTRUMENT refer to LEASE OF CONTRACT OF ONE (1) DOOR / UNIT of an apartment
located along Bagasbas Road, Barangay VI, Daet, Camarines Norte, the same consists of four (4) pages
including this page, signed by the parties charged at the end of the deed found on Page 3 and on the left
hand margin of Pages 1, 2 and 4 and each and every pages thereof, in the presence of two (2)
instrumental witnesses who both signed the same and sealed by my notarial seal.
