Unlimited Employment Contract ‫عقد عمل غير محدد المدة‬

WHEREAS, both parties having full legal capacity to contract, ‫حيث أن الطرفان يتمتعان باألهلية القانونية الالزمة البرام هذا‬

The Employee accepts to work for the Employer as ‫اتفق الطرفان على أن يعمل العامل لدى صاحب العمل‬

During the probation period either Party may terminate this ‫خالل فترة التجربة يحق ألي من طرفي العقد انهاؤه دون حاجة ألي‬

Working Hours: Up to maximum 8 hours a day or 48 hours a ‫ ساعـة‬48 ‫ ساعات فـي الـيـوم أو‬8 ‫ بحـد أقـصى‬:‫ساعات العمل‬

Annual Leave and Holidays: The Employee shall be ‫ يحصل العامل على اجازة‬:‫االجازة السنوية والعطل الرسمية‬
entitled to 30 days of paid leave per year. In addition to ‫ كما يحصل العامل على‬،‫ يوم‬٣٠ ‫سنوية مدفوعة األجر تحدد ب‬
the paid public holidays in the UAE as declared by the ‫اجازة براتب كامل في جميع أيام العطل الرسمية التي يتم‬

‫‪End of Service Allowance: The Employee shall be entitled for an‬‬ ‫مكافأة نهاية الخدمة‪ :‬يحصـل الـعـامـل عـلــى مـكـافـأة نـهـايـة‬
‫‪end of service allowance in accordance with the Applicable Law.‬‬ ‫خـدمة وفـقــًا ألحـكــام الـقـانـون الـمــطـبـق‪.‬‬

‫‪Employee’s Repatriation Fees: The Employer shall pay the‬‬ ‫نــفــقــــــات عــودة العــامــل‪ :‬يلـتـزم صــاحـب الـعــمـل بنــفــقـــات‬
‫‪expenses of the employee repatriation in accordance with the‬‬ ‫عـــودة الـعـــامـــل إلــى مـوطـنـــه وذلــك وفـقــــًا ألحــكــــــام‬
‫‪Applicable Law.‬‬ ‫الـقــانـون الـمـطـبـق‪.‬‬

‫‪Termination Of Employment: This Contract may be terminated‬‬ ‫انـهـــاء العـقـــد‪ :‬يتم انهاء العقد بأن يقوم أي من طرفي‬
‫‪by giving a‬‬ ‫‪days prior written notice by either‬‬ ‫العقد باعطاء الطرف اآلخر اخطار كتابي مسبق ال تقل مدته عن‬

‫‪1. This Contract shall be governed, interpreted and construed‬‬ ‫‪1.1‬إن هـذا الـعـقــد يخـضــع‪ ،‬ويفـســـرن ويـتــم تــأويـلــه وفـقـــًا‬
‫‪in accordance with the Applicable Law.‬‬ ‫ألحـكــام القــانــون المـطــبـــق‪.‬‬

‫‪2. RAK courts shall have jurisdiction over any dispute arising‬‬ ‫‪2.2‬تكــون مـحـكـمــة رأس الخـيــمـة هــي المـحــكــمــة‬
‫‪out or in connection with this Contract.‬‬ ‫الـمـخـتـصـة فـي نـظــر أي نــزاع يـنشـأ أو يـتعـلق بـــهذا العقد‪.‬‬

‫‪3. This Contract is drafted in both Arabic and English, provided‬‬ ‫‪3.3‬حـرر هـذا الــعـقـد باللغـتيــن العـربيـة واالنكليزيـة‪ ،‬وفـي حـال‬
‫‪Arabic prevails in case of discrepancy.‬‬ ‫اخـتـالف النـص فإن النـص باللغـة العـربية هو واجب التطبيق‪.‬‬
