I, Ashok Ram Kumar, son of Late Sri. S. Ashok Kumar,

aged about 46 years, resident of Hyderabad do hereby sincerely and

solemnly affirm and state as follows:

1. I am the Deponent and the

Counsel on record herein and as such I am fully acquainted with the

facts of the case.

2. I submit that the IA Sr No. 161 /

10 was filed in the above OS seeking for impleading of the proposed

Respondent No. 3. The said IA was returned on 23-1-2010 with the

Objection of compliance of Rule 28.

3. I submit that the same could not

be complied with by me in time as I was indisposed because of health

reasons. The said applications have been taken from the registry today

and there is a delay of 5 days. The said delay in representation is neither

willfull, deliberate not wanton but for the reason mentioned above.
4. The Petitioner herein prays that

in the circumstances mentioned above the delay of 5 days in

representation in IA Sr. No. 161/10 be condoned and pass such further

Orders or Orders this Honourable Court may deem fit and necessary
