IF VESSEL FAILS TO MEET MINIMUM PERFORMANCE SPEED AT ANY TIME,

FROM A RECOGNISED WEATHER ROUTING COMPANY (AWT) OR ANY
OTHER INTERNATIONALLY RECOGNISED WEATHER ROUTING AGENCY
FOR THEIR ASSESSMENT. (ANY VESSEL NOMINATED UNDER THIS AGREEMENT
TO BE A MINIMUM 170,000 DWT AND MAXIMUM 185,000 DWT.)

- OWNERS CONFIRM VSL IS RIGHTSHIP APPROVED AND NOT BLACKLISTED IN


ANY OF THE W. AUSSIE PORTS

- OWNERS GUARANTEE THAT VESSEL IS FULLY SUITABLE AND ACCEPTABLE TO


PORT HEDLAND (BOTH SHIPPERS BHPB AND FMG)/ DAMPIER / PORT WALCOTT
AND OTHER NORMAL WEST AUST IRON ORE PORTS/ PLACES.

- OWNERS GUARANTEE THAT VESSEL (AND MASTER/OFFICERS/CREW) IS/ARE


FULLY ITF ACCEPTABLE AND WILL REMAIN SO DURING COURSE OF
THIS VOYAGE.
OWNERS ARE RESPONSIBLE FOR ALL AND ANY CONSEQUENCES/ DAMAGES/
LOSSES WHATSOEVER, CONSEQUENTIAL OR OTHERWISE, WHICH CHTRS MIGHT
SUFFER SHOULD VESSEL AND /OR CREW BE FOUND OUT NOT TO BE EMPLOYED

THE LAYCAN AT LOADPORT WITH ANY CARGO LOADED IN EXCESS OF 187,000 MT

FOR THE PURPOSE OF CALCULATING FREIGHT RATES.

- FREIGHT RATES FOR PORTS OTHER THAN THE BASE ROUTE ARE TO BE
CALCULATED ON AN OPEN BOOK BSS (BASIS ACTUAL PERFORMING VESSEL
BALLASTING FROM QINGDAO FOR TRADE VIA PORT HEDLAND or
WALCOTT/DAMPIER(PORT OF LOADING AT THAT SHIPMENT) TO QINGDAO).
THE FREIGHT RATE DIFFERENTIAL SHALL BE CALCULATED ON
THE FOLLOWING BASIS:

1. NO POSITIONING / RE-POSITIONING BENEFIT / COSTS TO BE


INCLUDED IN THE CALCULATION.
2. VESSEL TO PERFORM AT THE BELOW AVERAGE BALLAST AND LADEN SPEED
PROVIDED IN MATRIX AA. DESCRIPTION IN MATRIX AA ALSO TO BE USED
FOR FREIGHT DIFFERENTIAL CALCULATIONS AS STATED. (MATRIX AA TO BE
COMPLETED PRIOR TO CHTRS ACCEPT FOR EACH VESSEL NOMINATION) 3.
DISTANCES TO BE APPLIED AS PER THE LATEST EDITION OF NETPASS.
4. ALL WEATHER FACTORS TO BE APPLIED AT 5% REGARDLESS OF
ACTUAL CONDITIONS.
5. RIVER TRANSIT DURATIONS TO BE CALCULATED BASIS ACTUAL SOF
AT DISPORT(S).
6. BUNKER PRICES TO BE APPLIED BASIS PLATTS SINGAPORE,
10 DAYS PRIOR TO VALID NOR.

- DEMURRAGE/DESPATCH:

- OWNERS GUARANTEE EACH VSL NOMINATION IS RIGHTSHIP APPROVED FOR


THE FULL DURATION OF THIS FIXTURE AND WILL LOAD IN ACCORDANCE WITH
THE REQUIREMENTS OF THE RELEVANT PORT TERMINAL HANDBOOK.
- CHTRS NOMINATED AGENTS BENDS

- OWNERS TO PROVIDE THE LATEST FULLY COMPLETED ONLINE


QUESTIONNAIRE AND ALL VESSELS CERTIFICATES WITH
OWNERS/MANAGERS/MASTERS CONFIRMATION THAT ANY DEFICIENCIES
REPORTED HAVE BEEN RECTIFIED AND CONFIRMATION OF THE MEASURES
THAT HAVE BEEN PUT IN PLACE TO PREVENT THE SAME FROM RE-OCCURRING.
