Affidavit of Legitimation of Child - Joint

This document is a joint affidavit of legitimation of a child born outside of wedlock to parents who later married. It states that the father and mother were legally married, and prior to their marriage they conceived a child who was then born. At the time of conception there was no legal impediment to the parents marrying. JOINT AFFIDAVIT OF LEGITIMATION OF CHILD

We, ______(name of father)_______ and ______(name of


mother)_______, both Filipinos, of legal age, married and presently
residing at ______(address)_______, Philippines, having been duly
sworn in accordance with law, hereby depose and state:

1. That we have been legally married to each other on

solemnized by ____________________________. A copy of
our marriage certificate is attached hereto and made an integral
part of this affidavit.

2. That prior to our marriage and outside of wedlock, a child,

3. That at the time of the conception of said child, we were not


disqualified by any impediment to marry each other, and, therefore,
by virtue of our subsequent marriage, the said child is now
legitimated by operation of law, particularly Article 177 of the Family
Code of the Philippines (As amended by Republic Act 9858 approved
on December 20, 2009).

4. That we execute this affidavit to declare the truth of the


foregoing facts.

Article 177. Children conceived and born outside of wedlock of parents


who, at the time of conception of the former, were not disqualified by any
impediment to marry each other, or were so disqualified only because
either or both of them were below eighteen (18) years of age, may be
legitimated.

Art. 178. Legitimation shall take place by a subsequent valid marriage


between parents. The annulment of a voidable marriage shall not affect
the legitimation.
