CONFIRMATION LATTER TO PAY PENATY FOR NON-PERFORMANCE

We the Management of “Belomorsk" Commercial Seaport” in conformity with the Russian Ministry of Energy
with Registered address 186500, REPUBLIC OF KARELIA, BELOMORSK, PORT-POSELOK STR, DOM ZDANIE
RADIOSTANCII. Hereinafter referred to as the Refinery/Seller with corporate and legal right hereby confirms by this
Buyer has the option to receive payment from the Seller, in the event Seller does not perform as per this
contract. The maximum claim of 2% of the total value of the cargo will be collected by the Buyer in case
Seller does not provide verifiable Vessel receipts to the Buyer as POP. Seller has the right to demand 2%
of penalty if Buyer fail to send acceptable Pre –advice and IRWA with fund confirmation on MT760. Buyer
must pay 2% of total contract value in that case in 3 banking days.

The Seller’s Product is covered under Seller’s Insurance Policy, which covers all risks of loss or damage to
said cargo, including war, hijacking, explosion etc. from the time the cargo has passed the refinery’s pipe-
line center until arrival to the Discharge(Loading) Port, and covers all product in Seller’s storage tanks,
refineries, and pipeline transportation.
