Joseph B. Sudario affirms that: 1) He owns a Honda motorcycle that was parked when it was hit by a Toyota Hilux truck driven by Jessie Borinaga, resulting in Joseph's son's death. 2) After the accident, Jessie Borinaga paid Joseph 43,000 pesos for a new motorcycle to replace the wrecked one. 3) Joseph no longer wishes to pursue legal action against Jessie and waives any further claims arising from the accident.

JOINT AFFIFAVIT OF WAIVER

I, Joseph B. Sudario, of legal age, married, and a residents Brgy. Tingib


Pastrana, Leyte after having been duly sworn in accordance with law, hereby
depose and say.

1. That I am the registered owner of a Honda XRM colored black, bearing


Plate Number 080108, Engine Number KPY20E036369, Chassis Number KPY
20036374, CR Number 257183625 dated August 19, 2016;

2. That the abovementioned motorcycle, while it was parked beside the


street in the front of the house of Arturo T. Mirante in October 13, 2019
figured in a traffic accident on that same date when it was bumped/hit by
a Toyota Hilux pick-up truck colored silver metallic bearing Plate Number
P3D 630, Chassis Number MR0HA8CD7K1059073, Engine Number
1GD4714387 driven by one Jessie Borinaga y Rocaberte, 47 years old,
married, Motorpool Head of Mac Builders Corporation and a resident of
Brgy. Linao Ormoc City with Professional Driver’s License Number H03-
99033343 which resulted in our son’s ultimately death;

3. That after the said accident, said Jessie Borinaga y Rocaberte tendered to
me the amount of FORTY-THREE THOUSAND PESOS (Php 43,000) for the
down payment of a new motorcycle which serves as a replacement for my
motorcycle which was wrecked in the said accident;

4. That in view of the above, I am no longer interested in the filling of any case
in court, or in any forum may it be criminal, civil and/or administrative
against the aforesaid suspect and further quit myself in claiming further
damages that may arise in the future;

5. That I executed this affidavit to attest the truth of the foregoing and same
was executed in my own freewill and volition and was read to me in waray-
waray, the dialect I understand;

6. That I further say naught.
