Contract of Lease For Construction Equipment

This 3 month lease contract is between Lessor Nestor Noel Q. Dayag and Lessee Engineer Heraldo Daway Jr. for the rental of construction equipment including a mixer, grader, and road roller. The equipment will be used by the Lessee for business purposes from October 16, 2019 to January 15, 2020. The monthly rental fees are PHP 4,000 per hour for the grader and road roller and PHP 40,000 per day for the mixer. A mobilization fee of PHP 60,000 for each piece of equipment is due upon signing. The Lessee is responsible for any damage to the equipment while in use.

CONTRACT OF LEASE FOR CONSTRUCTION EQUIPMENT

KNOW ALL MEN BY THESE PRESENTS:

This contract of lease is made and executed in the City of Tuguegarao


by and between the following parties:

NESTOR NOEL Q. DAYAG, of legal age, and with business postal


address at 151 National Highway, Caggay, Tuguegarao City, Cagayan and
hereinafter referred to as the “LESSOR”;

- and -

ENGINEER HERALDO DAWAY, JR., of legal age, Filipino Citizen


with postal and residential address at ______________________ and is
hereinafter referred to as the “LESSEE”;

WITNESSETH

That the Lessor and Lessee by virtue of these presents formally agree
and put on record to effect the following terms and conditions in relation to
the leasing/hiring of the following equipment: 1) Mixer 2) Grader and 3)
Road Roller, such equipment shall be used by the Lessee for business
purposes only.

WHEREAS, the LESSOR had offered to lease the above-mentioned


equipment and the Lessee have accepted the offer;

NOW THEREFORE, for and in consideration of the foregoing premises


and the covenants and stipulations hereinafter contained, the LESSEE has
agreed to lease, as he hereby leases the above-described equipment, as
follows:

1. PERIOD
The lease shall be for a term/period of three (3) months to start on
October 16, 2019 and end on January 15, 2020.

2. RENTAL

The monthly rental fee shall be in Philippine Pesos, initially fixed as


follows:

a. Grader - 4,000.00/hour
b. Road Roller - 4,000.00/hour
c. Mixer - 40,000.00/day

A mobilization fee of 60,000.00 each shall also be paid by the


Lessee to the Lessor at the finalization/signing of this contract.

The maximum number of hours that such equipment be used is eight


(8) hours per day

3. In the event that the there shall be damage to the equipment or loss
thereof during the contract period while such are in use by the Lessee, the
same damage shall be borne by the Lessee
