RESOLUTION (Under the old rule, Sec. 1(a), Rule
20, allows submission to arbitration only);

• C. OTHER MATTERS AS MAY AID IN THE


PROMPT DISPOSITION OF THE ACTION.
PRE-TRIAL (CRIMINAL CASES)
MODERN CONCEPT
RULE 118

PT is mandatory. Court to consider, among other matters:

• A. Plea bargain;

• B. Matters that will promote fair and expeditious trial


of the criminal and civil aspects of the case.

A.M. No. 03-1-09 (Aug. 16, 2004)- Guidelines in the conduct


of PT authorizes the BCC, during the preliminary
conference, to assist the parties in reaching a settlement on
the civil aspect of the case.
EXPANDED CONCEPT OF PRE-TRIAL;
INCORPORATION OF ADR

ADR or Alternative Dispute Resolution

• is a process or procedure
• to resolve a dispute or controversy, other than by
adjudication of a presiding judge of a court or an
officer of a government agency
• a neutral third party participates to assist in the
resolution of the issues
• includes arbitration, mediation, conciliation,
early neutral evaluation, mini-trial, or any
combination thereof (Sec. 3 (a), R.A. 9285).

Court Mediation (ACM) and other
court- related ADR Services, including
arbitration.
ROLE of PMCO:
to actively promote the acceptance and use of alternative dispute
resolution (ADR) by:

• rationally establishing and managing effective and


efficient PMC units (and staff) nationwide
• engaging qualified, performing, and highly-motivated
mediators and PMC staff
• developing ADR programs and initiatives that are
both relevant and sustainable
• generating and utilizing to the optimum ADR
resources (research & policy materials, funds & other
means of support), and thereby,
• enabling the parties themselves to resolve the
disputes brought to the courts, resulting in the
decongestion of court dockets, fostering party
autonomy, and enhancing access to justice.
