Laws Applicable: Civil Code Art. 42. Civil personality is extinguished by death.The
effect of death upon the rights and obligations of the deceased is determined by law, by
contract and by will.
Facts: Kosain Manibpol and his family were asleep when he was awakened by their
dogs bark. When he got up to look into whats going on, he saw two men asking if they
could borrow his land. Right after he agreed, he was attacked. Ten or more men arrived
and started to hack and chop him, his wife and their seven children. Only he and his 6year-old daughter survived. The rest, his wife and six other children, died. Out of the
alleged fourteen assailants, only two were arrested; Ciriaco Baldesco and Bonifacio
Tirol were found guilty for seven counts of murder and two counts of frustrated murder.
They were sentenced to death penalty for each of the seven murders, imprisonment for
the frustrated murders, and were compelled to pay 42,000 pesos for indemnity.
Ciriaco Baldesco and Bonifacio Tirol filed for an appeal during which Baldesco died.
Issues: Whether or not Baldesco will be liable for civil damages.
Held: YES. Baldescos death extinguished his penal liabilities but not his civil liabilities.
His estate would is obliged to cover for his remaining civil accountabilities.
